VACATION
OF PARK
STREET FROM
DEMONT
TO COUNTY
ROAD B -2 EAST
Minutes from 9/14/05
Blesener opened the Public Hearing to review the proposed
vacation of Park Street lying between Demont Street and County
Road B -2 East.
The City Administrator reviewed the City Engineer's report dated
September 9, 2005 relative to the vacation. The Administrator
noted that the School District would like Park Street as abuts their
property vacated to allow them to expand their ballfield area. The
School District granted the City additional easements for sidewalks
as part of the County Road B -2 improvement project, and raised
the issue of the vacation of Park Street at that time. The
Administrator noted that Terrace Heights Mobile Home Park has a
private road located on the Park Street easement. This road
appears to extend approximately 5 feet east of the right -of -way
centerline. Therefore, vacation of the entire width would likely
present a problem for the mobile home park.
The Administrator noted the three recommendations outlined in the
City Engineer's report. These are:
1. The School could grant the mobile home park an
easement to allow the street to remain on their property (the
vacated Park Street that would accrue to the School District).
2. Terrace Heights could shift the street five feet to the
west thereby removing it from the vacated Park Street right -of -way.
3. The City could vacate only the east 20 feet of the
street right -of -way eliminating any potential issues with the
mobile home park's access road to and allow both the mobile
home park and the school full use of the road.
The Administrator noted that a fourth option would be to do
nothing at this time.
Blesener noted the need for storm sewer and utility easements.
The Administrator indicated that the City Engineer has
recommended that the City retain the necessary easements for
these utilities.
Keis asked what the School District's preference would be. The
Administrator indicated that the School District would like to
accrue as much additional land through the vacation as possible.
9
