✓ Allows the School District to expand field usage in the future. <br />✓ Protects public utilities in the area. <br />✓ Would eliminate the troublesome parking of equipment and vehicles along the school <br />district fence. <br />✓ Allows Terrace Heights' driveway to continue in its present location while still <br />providing room for snow storage on the east side of the drive (approximately five <br />feet). <br />✓ Avoids the need for easements or moving the drive serving Terrace Heights if a <br />greater area were to be vacated. <br />The Council may also want to consider the enactment of a license agreement with Terrace <br />Heights to document the existence of a private drive on public right -of -way, including the <br />appropriate indemnification clauses. This is not being recommended as a revenue source, but <br />only to protect the public's property interests. The City Attorney should comment on the <br />need for this type of agreement. <br />Therefore, staff recommends the vacation of the east 20 feet of Park Street lying between the <br />north right -of -way line of County Road B2 and the south line of the vacated Transit Avenue <br />right -of -way; subject to the retention of drainage and utility easements over the vacated area. <br />cc: Len Copt, ISD #623 <br />Terrace Heights <br />2 <br />
