CITY OF LITTLE CANADA <br />RESOLUTION VACATING STREET RIGHT -OF -WAY <br />WHEREAS, <br />The City Council of Little Canada has determined to vacate the east 20 feet of Park Street <br />lying between the north right -of -way line of County Road B -2 and south line of the <br />vacated Transit Avenue right -of -way; <br />AND WHEREAS, <br />A public hearing was held on September 14, 2005 and continued until October 12, 2005 <br />before the City Council in the City Center on such petition after due published and posted <br />notice had been given by the City Administrator, a reasonable attempt was made to give <br />personal notice to all affected property owners, and all persons interested were given an <br />opportunity to be heard; <br />AND WHEREAS, <br />Any person, corporation, or city owning or controlling easements contained upon the <br />property vacated, reserves the right to continue maintaining the same or to enter upon <br />such way or portion thereof vacated to maintain, repair, replace, remove, store or <br />otherwise attend thereto; <br />AND WHEREAS, <br />It appears that it will be in the best interest of the City to vacate such street; <br />AND WHEREAS, <br />Four -fifths of all members of the City Council concur in this resolution; <br />NOW, THEREFORE, BE IT RESOLVED, that the street described as follows is hereby <br />vacated: <br />The easterly 20 feet of Park Street lying between the north right -of -way line of County <br />Road B -2 and south line of the vacated Transit Avenue right -of -way; <br />subject to the retention of drainage and utility easements over the vacated area. <br />3 <br />
