Attachment A5 <br />DECLARATION OF COVENANTS <br />CONDITIONS, RESTRICTIONS AND RESERVATIONS <br />FOR <br />THE PRESERVE <br />THIS DECLARATION made this , day of September, 2005 by <br />Dayspring Development, LLC, a Minnesota limited liability company, (hereinafter <br />referred to as "Declarant "). <br />WHEREAS, Declarant is the owner of real property in the City of Little <br />Canada, County of Ramsey, State of Minnesota, described as: <br />Lots 1 through 13, Block 1, The Preserve <br />Lot 1, Block 2, The Preserve <br />Outlots A, B C, all in The Preserve <br />(the "Property" as more particularly defined in Article II below). <br />WHEREAS, Declarant desires to impose upon and subject the Property to <br />certain covenants, conditions, restrictions and reservations for the benefit of the present <br />and future owners of the Property. <br />NOW, THEREFORE, Declarant hereby declares that all of the Property <br />shall be held, sold and conveyed subject to the following covenants, conditions, <br />restrictions and reservations which are hereby declared to be for the benefit of the <br />Property described herein and the owners thereof, their successors and assigns. These <br />covenants, conditions, restrictions and easements shall run with the Property and shall <br />be binding on all parties having or acquiring any right, title or interest in the Property or <br />any part thereof and shall inure to the benefit of each owner of any lot herein described <br />and are imposed upon the Property and every part thereof as a. servitude in favor of <br />each and every parcel thereof as the tenement or tenements. <br />
