An Interim Use <br />Permit is essentially a Conditional Use Permit with a time limitation. The time limitation <br />must be agreed to by the applicant for such a permit, whereas the more common <br />Conditional Use Permit runs with the land so long as the conditions of the permit are <br />met. <br />The attached ordinance includes two basic components. The first (Sections 1 and 2 of <br />the Ordinance) establish Interim Use Permits in the Administrative processing section of <br />the Zoning Ordinance. We have placed this language in Chapter 921 which establishes <br />the processing requirements for Amendments and Conditional Use Permits. <br />The second component of the ordinance (Section 3) establishes Outdoor Display of <br />Retail Merchandise as an Interim Use Permit in the B -3 District, and lists the conditions <br />under which such a permit may be considered. <br />The Planning Commission preferred the use of the Interim Use Permit process, rather <br />than the Conditional Use Permit to allow for better control of what could turn out to be <br />an unsightly condition if abused. The Commission placed a proposed termination date <br />of December 31, 2007 for the Joe's Sporting Goods IUP, after which a new permit <br />would need to be applied for if the applicants wish to continue the use. <br />Pc: Kathy Glanzer <br />Steve Westerhaus <br />Lee Elfering <br />
