City of Little Canada, Minnesota <br />Ordinance <br />AN ORDINANCE AMENDING CHAPTER 921 AND 912 OF THE LITTLE CANADA <br />CITY CODE, KNOWN AS THE ZONING ORDINANCE, BY PROVIDING FOR <br />INTERIM USE PERMIT PROCESSING AND OUTDOOR DISPLAY OF RETAIL <br />MERCHANDISE BY INTERIM USE PERMIT IN THE "B -3 ", GENERAL BUSINESS <br />ZONING DISTRICT. <br />The City Council of the City of Little Canada hereby ordains: <br />Section 1. <br />Section 921 is hereby amended to read as follows: <br />921. ADMINISTRATION - AMENDMENTS (INCLUDING REZONINGS), INTERIM <br />USE PERMITS, AND CONDITIONAL USE PERMITS <br />Section 2. <br />Section 921.030 is hereby amended to add the following: <br />F. Interim Use Permits. Interim Use Permits may be granted by the City Council where <br />allowed by Zoning District, subject to the same process as that required for Conditional Use <br />Permits under this Chapter. Each Interim Use Permit shall include a requirement for a <br />recordable Development Contract between the City and the owner and applicant which specifies <br />the date and/or conditions for termination of the Interim Use Permit. Said Development Contract <br />shall be executed prior to any building, grading, or other permit may be issued to the project. <br />The use allowed by the Interim Use Permit shall terminate on or before the termination period <br />listed in the Development Contract, and no extension may be granted. Continuation of the use <br />may be allowed only by issuance of a new Interim Use Permit under the terms of this Chapter. <br />The owner and applicant shall expressly agree and acknowledge that neither the grant of an <br />Interim Use Permit, nor the improvements made pursuant to such Permit, shall confer any right <br />or preference to a subsequent Permit for the same or similar use in the future. <br />Section 3. <br />Section 912 is hereby amended to add the following: <br />912..045. INTERIM USES. (Requires an Interim Use Permit based upon procedures set <br />forth in and regulated by Section 921 of this Ordinance. <br />A. Outdoor display of retail merchandise accessory to a retail sales facility, <br />provided that: <br />1. The merchandise being sold is a part of the array of merchandise also sold <br />indoors on the premises in question, and is not being sold "on consignment" <br />or for another off - premises seller. <br />The merchandise being displayed, or the display area, does not include any <br />advertising, material, or messages that could be construed as a sign under the <br />
