must be approved by the Committee prior to the presentation to the City or the County. <br />This Section is intended to define the procedure for application for variance, and does <br />not impair an individual's right to request and obtain a variance from the City or the <br />County. <br />ARTICLE VIII. <br />LANDSCAPE PLAN AND EROSION CONTROL <br />Section 1. Landscape Plan. Each Owner must submit a landscape plan <br />for approval to the Architectural Control Committee prior to altering any portion of the <br />Lot. Said landscape plan must preserve, manage, and protect the natural values of the <br />Lot and surrounding areas, including, but not limited to 75' average buffer between the <br />wetland and the buffer setback <br />Section 2. Protection of Natural Values. The Owner agrees to protect the <br />natural value of the Lot in the protected buffer area by: <br />(a) neither using, conducting, nor permitting any activity on the Lot injurious to <br />the natural values of the Property; <br />(b) neither introducing nor removing, destroying, damaging, collecting, <br />chemically treating, burning, mowing, cutting, or trimming trees, shrubs, or <br />plants, including plant parts and seeds; <br />(c) neither damaging, destroying or removing any natural materials, including <br />rocks, minerals, fossils, soil, and dead or downed wood, except incidental <br />dead or downed wood which interferes with the conservation of the <br />Property; and, <br />(d) neither performing any topographic changes, extracting subsurface <br />materials, or altering the natural landscape or waters by excavation, filling, <br />15 <br />- 1 5 - <br />
