improvements in it shall be maintained continuously by the Owner of the Lot, except for <br />those improvements for which a public authority or private utility company is <br />responsible. <br />Section 2. Each and every Lot of The Preserve is hereby declared to be <br />subject to an easement in favor of the Association and its members for the operation, <br />maintenance, repair and /or replacement of all subdivision entrance monuments, <br />lighting, ponds, rain gardens, retaining walls, landscape berms and signs that may be <br />constructed for which the Association has an ownership interest or responsibility for <br />maintenance and upkeep, including those items as may be constructed on the Common <br />Areas. <br />Section 3. The Declarant reserves the right, so long as Declarant owns a <br />Lot, for itself and for the Board of Directors of the Association, without joinder or consent <br />of any person or entity whatsoever, to grant such additional easements, including, but <br />not limited to, irrigation, cable television, television antennas, electric, gas, water or <br />other utility easement, or to relocate any existing utility easement in any portion of the <br />Property as the Declarant or the said Board of Directors shall deem necessary or <br />desirable for the proper operation and maintenance of the Property, or any portion <br />thereof, or for the general health or welfare of the Lot Owners, provided that such <br />additional utilities or the relocation of existing utilities will not prevent or unreasonably <br />interfere with the use of the Lot for permitted purposes. <br />Section 4.
