of the Owner covering the same property, and may not be brought into contribution with <br />any insurance purchased by Owners or their Eligible Mortgagees. <br />Section 8. Effect of Acts Not Within Association's Control. All policies <br />of insurance maintained by the Association shall provide that the coverage shall not be <br />voided by or conditioned upon (i) any act or omission of any Owner or Eligible <br />Mortgagee, unless acting within the scope of authority on behalf of the Association, or <br />(ii) any failure of the Association to comply with any warranty or condition regarding any <br />portion of the Property over which the Association has no control. <br />Section 9. Owner's Insurance. Each Owner, at his or her own expense, <br />must keep all buildings, improvements and fixtures now or later located on or a part of <br />his or her Lot insured against loss by fire, extended coverage perils, vandalism and <br />malicious mischief for at least the FULL INSURABLE VALUE of the Lot and <br />improvements located on the Lot. Said insurance shall cover fire and other casualty to <br />the Lot, personal property or personal liability. <br />ARTICLE XXI. <br />MAINTENANCE AGREEMENT <br />Section 1. Each Lot Owner shall bear its share, as set forth herein, of all <br />expenses whether minor or major, foreseen or unforeseen, routine or special, related to <br />the maintenance, repair and /or replacement of all subdivision monuments, lighting, <br />signs, private streets, berms, ponds, rain gardens, wetlands, retaining walls and <br />landscaping which are the responsibility of the Association, whether constructed on the <br />Common Areas or individual Lots as described herein. <br />Section 2. The Owners agree to maintain their Property and the Common <br />Areas without the use of phosphorus based fertilizer. <br />26 <br />- 2 6 - <br />
