MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 8, 2005 <br />fishing and skiing. He also noted that Joe's has received a Community <br />Pride Award for the appearance of their property. <br />Knudsen stated that he supported the outdoor display of these items as <br />long as it was done in a limited fashion as recommended by the City <br />Planner, Knudsen stated that his only concern was the precedent that this <br />would set for other B -3 properties in the City. <br />Duray asked if B -3 properties are allowed outdoor storage. The Planner <br />replied that they are not. <br />The Planner noted his recommendation that an Interim Use Permit should <br />be utilized for allowing outdoor seasonal displays in the B -3 District. A <br />termination date would be established under an Interim Use Permit, which <br />gives the City more enforcement authority if a property owner is abusing <br />the situation. <br />Knudsen asked if #2 in the Planner's report should be more restrictive. <br />The City Planner indicated that the intent of this restriction is that the <br />merchandise being displayed does not include advertising such as store <br />name or price. Rauscher indicated that the trampoline they had displayed <br />did include the brand name. <br />The Planner indicated that if the merchandise displayed includes a <br />message that is not readable from the street, then for purposes of the sign <br />ordinance, that message would not be considered a sign. <br />Knudsen noted that Joe's location does not have adjacent residential <br />properties to be concerned with. <br />Hall noted that the Code's definition of a sign does not include any <br />qualifiers about size or visibility. The Planner indicated that it is his <br />interpretation that when a message is not visible to the general public <br />driving buy, it is not considered a sign. <br />Hall asked if an amendment to the Code is needed to establish an interim <br />permit in the B -3 District. The Planner repotted that it would. <br />Hall asked if Joe's has plans to do more outdoor displays than it has <br />already done. Rauscher replied that they would like to display the water <br />trampoline on both sides of the building. They would also like to have <br />more tri -pod hunting stands and canoe and kayak display racks. Rauscher <br />noted the display locations shown on their site plan. <br />Barraclough asked about the 5% display area limitation proposed by the <br />City Planner. The Planner indicated that the 5% would be of all usable <br />7 <br />
