D Little Canada, MN 55117 RE: 03 -136 — Proposed New Development — Sec. 8, T -29 -N, R -22 -W, Ramsey Co., MN Dear Mr. Brault: You have expressed a need for an additional 10 -foot wide area in your proposed subdivision The Preserve for a road (Preserve Court as shown on the plat you provided us), through the portion of your proposed subdivision that includes Lot 1, Block 1, Little Canada Mid Oaks subdivision. In our discussions, you proposed to exchange a triangular tract (shown on the plat drawing you sent us) for the additional 10 -foot road area referenced above. Magellan Pipeline Company, L.P., is agreeable in principle to your proposal, subject to the landowner agreeing to void the document entitled Release of Right of Way executed by Williams Pipe Line Company, LLC on August 29, 2003 (which you have told me has never been placed of record) which released Williams' right of way on a tract of and which comprises the bulk of your land in the proposed subdivision, and the landowner then agreeing to accept in its stead a new Partial Release and Grant of Right of Way on Magellan's current form which would describe the same land described in the Release of Right of Way dated August 29, 2003, except that the new description would include a reservation of right of way by Magellan of the triangular tract described above, for which you would provide a good survey description.
