D <br />Little Canada, MN 55117 <br />RE: 03 -136 — Proposed New Development — Sec. 8, T -29 -N, R -22 -W, Ramsey <br />Co., MN <br />Dear Mr. Brault: <br />You have expressed a need for an additional 10 -foot wide area in your proposed <br />subdivision The Preserve for a road (Preserve Court as shown on the plat you <br />provided us), through the portion of your proposed subdivision that includes Lot <br />1, Block 1, Little Canada Mid Oaks subdivision. In our discussions, you <br />proposed to exchange a triangular tract (shown on the plat drawing you sent us) <br />for the additional 10 -foot road area referenced above. <br />Magellan Pipeline Company, L.P., is agreeable in principle to your proposal, <br />subject to the landowner agreeing to void the document entitled Release of Right <br />of Way executed by Williams Pipe Line Company, LLC on August 29, 2003 <br />(which you have told me has never been placed of record) which released <br />Williams' right of way on a tract of and which comprises the bulk of your land in <br />the proposed subdivision, and the landowner then agreeing to accept in its stead <br />a new Partial Release and Grant of Right of Way on Magellan's current form <br />which would describe the same land described in the Release of Right of Way <br />dated August 29, 2003, except that the new description would include a <br />reservation of right of way by Magellan of the triangular tract described above, for <br />which you would provide a good survey description. <br />Please let me know if you would like to proceed with the above - described <br />transaction. <br />Sincerely, <br />DavidS. 9ttains <br />David S.
