b. The Grading and Drainage Plan submitted for City Council approval <br />has not been updated to fully reflect the revised retaining wall and <br />grading design of rear yards on most lots in the plat. <br />Commentary: The revised final plat is more consistent with the preliminary plat <br />and with the discussions from staff meeting with developer on 9/1/05. <br />c. The Grading and Drainage Plan varies significantly from the <br />Preliminary Plat by creating the need for several steep (2:1 ratio) <br />slopes from the building pad area to the wall that is adjacent to the <br />wetland and wetland buffer area. This wall is needed to support the <br />lot. <br />Commentary: The revised final plat is more consistent with the preliminary plat <br />and with the discussions from staff meeting with developer on 9/1/05. <br />d. The Grading and Drainage Plan varies significantly from the <br />Preliminary Plat by creating the need for a retaining wall of more <br />than ten feet in height supporting a proposed public street and <br />utility lines that would be severely affected by any defect in the <br />wall. <br />Commentary: The revised final plat is more consistent with the preliminary plat <br />and with the discussions from staff meeting with developer on 9/1/05. <br />e. The Grading and Drainage Plan results in removal of landscaping <br />required by the conditions of the Preliminary Plat approval, <br />including landscaping along the south boundary of the right of way, <br />and landscaping along the wetland buffer. <br />Commentary: Changes have been made in the final plat that are consistent with <br />the intent of previous staff concerns. <br />2. Preserve Court Road Right-of-Way Issues. <br />a. The Final Plat proposes to create a right of way dedication for public <br />street, a portion of which is encumbered by the Williams Bros. <br />pipeline easement, in contradiction to the conditions attached to the <br />Preliminary Plat approval, and in contradiction to the City's right of <br />way ordinance (City Code Chapter 2302). <br />Commentary: This issue now appears to be resolved based upon the developer's <br />representation that Magellan (Williams) will vacate 10 feet of their easement to <br />achieve an unencumbered right -of -way. (See Attachment C — Letter from <br />Magellan). Therefore, the location of the road will remain as originally <br />proposed, but our right -of -way will no longer be encumbered by the pipeline <br />easement. <br />
