MINUTES <br />CITY COUNCIL <br />JANUARY 28, 2004 <br />Upon motion by Anderson, seconded by Montour, the public hearing was <br />closed. <br />Mr. Montour introduced the following resolution and moved its adoption: <br />RESOLUTIONATO. 2004 -1 -20— VACATING THE EASTERLY 10 <br />FEET OF BOSS ROAD FROM BRYAN STREET TO L,4BORE <br />A VENUE <br />The foregoing resolution was duly seconded by Anderson. <br />Ayes (4) Montour, Anderson, Blesener, LaVaile. <br />Nays (0). <br />Abstains (1). Resolution declared adopted. <br />EXCEPTION Mayor Fahey opened the public review to consider the request by C. I. <br />TO NOISE Title and RAB, LLC for an exception to the City's noise ordinance for <br />ORDINANCE the generator at the C. I. Title building. <br />FOR <br />GENERATOR Greg Wilson, RAB, LLC, appeared before the Council and reported that <br />AT C. I. TITLE they are trying to minimize the impact the generator is having on the <br />BUILDING adjacent residential properties. He noted that initially the generator was <br />run once per week for two hours. That running time has now been <br />reduced to twice per month for a half hour. Wilson indicated that in the <br />spring the plan would be to screen the generator with a berm and /or <br />vegetation. They had reviewed the possibility of enclosing the generator, <br />but there was no guarantee that an enclosure would reduce the decibel <br />level of the generator. <br />Blesener suggested a sort of band shell screening on the west side of the <br />generator that may cause noise to be directed toward the east. <br />John Grant, 2901 Condit Street, reported that while the frequency the <br />generator runs has decreased, there has been no decrease in noise level. <br />The generator is still very loud which is especially problematic during the <br />summer. Grant indicated that there needs to be some screening of the <br />generator with either berming and plantings or an enclosure. <br />Fahey suggested that the Public Works Director work with the property <br />owners on screening and /or enclosure options to determine the best <br />method for reducing noise levels for the residential neighborhood. It was <br />suggested that the matter then be brought back to the Council in April or <br />May for action on the request for an exemption from the noise ordinance. <br />6 <br />
