Buck Blacktop — 32 S. Owasso Blvd. <br />This has been a long - standing code enforcement concern with a number of issues. One of the <br />major problems is the outdoor storage. Code enforcement has sent him numerous letters and at <br />one time he agreed to have the site cleaned and remove the outdoor storage. I wanted to make <br />the Council aware that this will be one of the items I will start looking at in the next few months. <br />Precision Tree — 50 S. Owasso Blvd. <br />I inspected the site on May 4, 2004. I mailed the attached letter to Precision Tree to deal with <br />some of the new violations present on the property. At this time, Mac Groholski is requesting to <br />have his amendment tabled to come up with a more accurate site plan. The new site plan will <br />also provided future plans for the site. Mac has set up a meeting with the City Planner for May <br />17, to go over the site plan and other possible alternatives. Mac is contemplating a request to <br />rezone the property to PUD and add an additional building. <br />Buetow Brothers — 3104 Edgerton Street <br />Joel received a call from Ed McCumber on April 29. He (Arcade Electric) has purchase the <br />Buetow Brothers stucco building on the SE corner of Edgerton & County Road D. <br />He will clean up the site and has a tenant interested in re -use of the house for a small office set- <br />up (internet company). It only involves a couple of employees and may go for a two to five year <br />period. I'm asking the Planner if there are any issues /approvals we need to facilitate this change. <br />It also sounds as if they may add a small addition to the existing house to improve the entry area <br />and provide a storage area. All in all, it appears a long - standing problem is solved. Mr. <br />McCumber indicated their long -term goals will be to add on the existing building and improve <br />the aesthetic appearance but that is likely a few years off. <br />Xcel Energy — 3064 Rice Street <br />Notices were posted on the cars, trucks, and equipment being stored at the site the evening of <br />Thursday, Feb 12 and the daytime on Friday, Feb 13. The notice informed them that as of <br />Monday, Feb 16 any vehicle or equipment present would immediately result in the issuance of a <br />citation. I have conducted several inspections of the site and noted that there have been no <br />vehicles or equipment on the lot since that time. I also had the sheriff's department keep their <br />eyes open and they have not seen any activity on the site nor have they issued any citations. <br />On February 16, 2004 we did receive a letter from the attorney representing Xcel Energy. In his <br />letter he urges the City to consider a few items. The main point being that Xcel Energy is <br />grandfathered in because they have been using the site since 1955 with no lapse in time for use. <br />In response to that letter, Pat Sweeney sent a letter explaining we are not in agreement with that <br />and if they had supporting documentation they should provide that for staff to review. No <br />evidence has been provided by Xcel Energy or their representatives. We also had the watershed <br />send us aerial photos of that property. In the 2003, 1996, 1985, 1974, 1953, and 1940 there are <br />no vehicles or equipment present on the site. <br />In August we will be sending a letter to Xcel Energy letting them know they have lapsed in the <br />use of the property for 6 months, which takes away the grandfathered status. While the City <br />does not agree that they are grandfathered in, this letter will take away future claims on Xcel's <br />part. <br />ItvJessica.'
