MINUTES CITY COUNCIL FEBRUARY 23, 2004 Anderson asked if US Bank will be a part of the Sherman redevelopment project. The City Administrator indicated that US Bank has not yet decided whether or not it will be part of the redevelopment project, but the City is now at the point where the street needs to be rebuilt. The City Engineer noted that Option 1 would also require an additional 6 feet of right -of -way for the sidewalk. Under Option 2, the City would be able to vacate 10 feet of excess right -of -way, still retaining 60 feet of road right-of-way. There would be the need to straighten the right -of -way on the north end, and it would be necessary to acquire an additional 7 feet of right -of -way from the property on the east for that northerly section of Middle Street. The City Administrator noted that it may be preferable to move the sidewalk to the east side of the street to eliminate a crossing movement. The City Administrator also noted that the Sherman concept plan for the commercial area may be under parked by about 40 spaces if the layout with a restaurant and the current US Bank layout remain. There may need to be an amendment to the Sherman Development Agreement to address that issue. There was no one from the general public present wishing to comment on this improvement. Upon motion by Fahey, seconded by LaValle, the public hearing was closed. It was noted that the improvement cannot be ordered this evening, as there are only three members of the Council present. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 2004 -2 -39 — RECOMMENDING TO THE FULL COUNCIL AT ITS ?vL4RCFI 10, 2004 MEETING THAT THE IMPROVEMENT OF MIDDLE STREET; OPTION 2, BE ORDERED AND THE CITY ENGINEER AUTHORIZED TO PREPARE PLANS AND SPECS The foregoing resolution was duly seconded by Anderson. Ayes (3) Fahey, Anders, LaValle. Nays (0). Resolution declared adopted. IMP. NO.
