MINUTE
CITY COUNCIL
AUGUST 25, 1999
The Zoning Administrator pointed out that there are two businesses
located on the property. Wally's Auto Body requires 3 to 5 cars, while
Benchmark Auto requires 5 to 10. This is the basis of the
recommendation for 15 cars.
Scalze stated that she does not have good definitions of repairable and
antique vehicles. Scalze asked if the titles of these vehicles are marked as
salvage. Carlson replied that the vehicles will have dealer plats or no plate
at all. He also indicated chat he typically completes a repairable within 60
days, unless he has customer work that delays his work on spec
automobiles.
Fahey pointed out that the property has never been issued a CUP for the
outdoor storage of automobiles. Fahey did not feel the City should
immediately require Mr. Carlson to cease his operation, but should allow
him a period to time to continue while he is looking for a site to relocate
to. Fahey suggested that inconsistencies with the Code should be
addressed. He also suggested a sunset date of December, 2000 for the
Benchmark Auto business. Fahey stated that he supports the
recommendation of the Zoning Administrator for this property and
stressed the need for consistent enforcement in Ryan Industrial Park.
There was no one else from the general public wishing to comment on this
matter.
Upon motion by Morelan, seconded by LaValie, the public hearing was
closed.
Mr. Morelan introduced the following resolution and moved its adoption:
RESOLUTION NO. 99-3-223 —APPROVING THE CONDITIONAL
USE PERMIT FOR OUTDOOR STORAGE OF EQUIPMENT .AND
MATERLALS AS AN ACCESSORY USE FOR 3176 SPRUCE STREET
SUBJECT TO COMPLIANCE WITH THE RECOMMENDATIONS
OF THE ZONING ADMINISTRATOR AS O UI LINED PV HER
REPORT DATED AUGUST 19, 1999
The foregoing resolution was duly seconded by Fahey.
:Yves (5) Morelan, Fahey, Scalze, LaValle, Pedersen.
Nays (0).
