MINUTES <br />CITY COUNCIL <br />DECEMBER 17, 2003 <br />CUP FOR <br />GARAGE — <br />57 BRYAN <br />AVENUE — <br />DICK BOSS <br />Mayor Fahey opened the public hearing to consider the application <br />for a Conditional Use Permit for a second garage as well as total <br />garage space over 1,000 square feet requested by Dick Boss at 57 <br />Bryan Avenue. Fahey noted that the City Planner and the Planning <br />Commission have recommended approval of the CUP. Fahey also noted that <br />Mr. Boss is his brother -in -law, therefore, he would not participate in the <br />discussion or the vote on this issue. <br />Acting Mayor LaValle asked Mr. Boss for an explanation of his request. Dick <br />Boss reported that his lot consists of over an acre of property. He would like to <br />construct a second garage on the property adjacent to the hockey rink area on his <br />property. Boss noted, however, that the small storage building on the western <br />edge of his property straddles the lot line. Therefore, he is requesting that the <br />eastern 10 feet of Boss Road be vacated to resolve that issue, He noted that the <br />right -of -way for Boss Road is 60 feet wide, and the current City standard for <br />residential roads is 50 feet. <br />The City Administrator noted that a public hearing will have to be held to <br />consider the vacation of a portion of Boss Road. If the City Council initiates the <br />hearing, the vacation will require a 4 /5ths vote for approval. If Mr. Boss <br />petitions for the vacation, approval will require a 3 /5ths vote. <br />The City Planner agreed that the vacation of 10 feet of Boss Road would resolve <br />the issue with the storage stied on the western edge of the property. However, <br />the garage proposed by Mr. Boss could be located to meet the City's setback <br />requirements regardless of whether or not the vacation is approved. <br />Blesener asked about the old hockey shack located on the eastern side of the <br />hockey rink. Boss reported that the shack is dilapidated and would be removed. <br />As a result, the buildings that would exist on the property are the house with <br />attached garage, the storage shed on the western edge of the property and the <br />garage being proposed this evening. <br />Blesener asked how the proposed garage differs from the situation with the <br />Cossack property on Eli Road. The City Planner noted that with the removal of <br />the dilapidated building, the Boss property would have one attached garage and <br />one detached garage totaling less than 1,500 square feet (CUP required). The <br />property would also have a storage shed of 120 square feet or less (permitted <br />under the Code). <br />There was no one present from the general public wishing to comment on this <br />matter. <br />Upon motion by Blesener, seconded by LaValle, the public hearing was closed. <br />7 <br />5 <br />
