AGREEMENT FOR PROFESSIONAL ENGINEERING SERVICES <br />This Agreement is made this <br />day of , 2004 between: <br />The City of Little Canada, Ramsey County, Minnesota <br />hereinafter called "THE CITY" and <br />Elfering & Associates, PLC a professional corporation with offices at: <br />17562 Dunkirk Street <br />Ham Lake, MN 55304 <br />hereinafter referred to as "THE ENGINEER ". <br />WHEREAS, THE CITY is authorized and intends to employ the services of THE <br />ENGINEER from time to time in the construction of public works and in providing general <br />engineering services for THE CITY, and <br />WHEREAS, the services will include, in some instances, construction projects <br />comprised of a full project sequence to include the development of reports, public <br />meetings, plans and specifications, bidding documents, contract administration and <br />construction inspection, and <br />WHEREAS, in other instances the work may vary and not include the full project <br />sequence, and <br />WHEREAS, it is intended that this Contract shall govern the terms of <br />employment of THE ENGINEER and all the conditions thereof, and THE CITY desires to <br />engage the services of THE ENGINEER in connection with said work: <br />NOW, THEREFORE, IN CONSIDERATION of the mutual covenants of this <br />Agreement as set forth herein, <br />IT IS AGREED BY and between the parties as follows: <br />Section I. <br />THE CITY hereby employs THE ENGINEER to furnish and perform the <br />professional services hereinafter specified, subject to the conditions noted <br />herein below; and THE ENGINEER agrees to render and perform any <br />and all engineering services in connection with any of the above - <br />mentioned work, in the manner and subject to the conditions noted <br />herein. <br />Section 11. THE ENGINEER, upon direction of THE CITY, agrees to perform the <br />following Engineering Service for Projects: <br />1. General: THE ENGINEER shall serve as THE CITY's professional <br />representative in the planning, design, and general review of <br />construction of Improvement Projects, and shall give consideration <br />and advice to THE CITY during the performance of his services. <br />2 <br />
