Ilanson <br />www. ci.little- canada.mn. us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: August 5, 2004 <br />RE: Resignation of Council Member Anderson <br />Attached is a letter from Council Member Anderson stating his intent to resign from the City Council at <br />the end of August. While being very disappointed with the thought of losing Matt off of the City Council, <br />we need to address his replacement. <br />Given Council Member Anderson's term expires at the end of 2004, the City Council may appoint a <br />person to fill the unexpired portion of his term. (The City Attorney states that we should act on his letter <br />of resignation and then pass a resolution declaring a vacancy in the office at the effective date of the <br />resignation.) In discussing this matter with the Mayor and City Attorney, it is recommended that we <br />declare the vacancy, but not appoint anyone until after the general election to be held on November 2id. <br />In this way, no person will be given a competitive advantage for the election due to an earlier <br />appointment. <br />It is also recommended that we call for a special meeting on the day following the election (we will also <br />be meeting that day to canvass the election results) for the purpose of appointing the winner of the <br />election to fill the unexpired term. By doing so, a new person would be in place for the first meeting in <br />November. <br />The Council should discuss this matter to determine its final course of action. The City Attorney will be <br />prepared to talk about any legal concerns involving this issue. <br />
