Ilanson www. ci.little- canada.mn. us MEMORANDUM TO: Mayor Fahey & Members of the City Council FROM: Joel Hanson, City Administrator DATE: August 5, 2004 RE: Resignation of Council Member Anderson Attached is a letter from Council Member Anderson stating his intent to resign from the City Council at the end of August. While being very disappointed with the thought of losing Matt off of the City Council, we need to address his replacement. Given Council Member Anderson's term expires at the end of 2004, the City Council may appoint a person to fill the unexpired portion of his term. (The City Attorney states that we should act on his letter of resignation and then pass a resolution declaring a vacancy in the office at the effective date of the resignation.) In discussing this matter with the Mayor and City Attorney, it is recommended that we declare the vacancy, but not appoint anyone until after the general election to be held on November 2id. In this way, no person will be given a competitive advantage for the election due to an earlier appointment. It is also recommended that we call for a special meeting on the day following the election (we will also be meeting that day to canvass the election results) for the purpose of appointing the winner of the election to fill the unexpired term. By doing so, a new person would be in place for the first meeting in November. The Council should discuss this matter to determine its final course of action. The City Attorney will be prepared to talk about any legal concerns involving this issue.
