surrounding land uses, that the highest and best use of the subject property as vacant or improved <br />would be its continued use or some non - residential use. <br />DESCRIPTION OF THE PROPERTY (before): <br />Subject property's caption as shown on the right of way map reads as follows: <br />Entire Tract (wo /Rds) 102,324 s.f. <br />New T.H. R/W 37,229 s.f. <br />Balance 65,095 s.f. <br />T.E. (Exp. 12 -1 -2009) 10,450 s.f. <br />The subject property is mostly rectangular in shaped except for the south portion, which is irregular in <br />shape primarily due to a jog in the property line to accommodate an existing pond located on State <br />property. The boundaries of the property are: to the north, business /commercial uses, to the east <br />Interstate 35E and the right of way associated with it, to the south and west is Country Drive and on <br />the west side of that street is a combination of mixed uses including multi- residential, mobile home <br />park and a scattering of business /commercial. <br />The property is mostly at grade with Country Drive and is level. The north portion of the subject <br />property is improved with a public works garage and a fenced in area for equipment storage. There <br />is a small parking lot to the south of the building. The remaining property is mostly open and grass <br />covered. Located in the acquisition area, which is west of the State's ponding area, is variety of 8 <br />trees, which will be handled through a Cost to Cure. The far south end of the property is being used <br />as storage of woods chips, which are free for the taking, by the residents of Little Canada. <br />DESCRIPTION OF THE ACQUISITION AND TEMPORARY EASEMENT AREAS: <br />The fee acquisition area is located in the southern portion of the subject property. It starts <br />approximately 300 feet south of the parking lot entrance. It runs approximately 550 feet southerly at <br />widths between 40 and 135 feet for a total area of 37,229 s.f. The fee acquisition area is shaded in <br />red on the enclosed parcel sketch. Located in the acquisition area are a variety of 8 trees, which will <br />be handled through a Cost to Cure. There are three temporary easement areas located on the <br />subject property. These areas are shaded in green on the enclosed parcel sketch. The first area is a <br />small 500 +/- square foot area located in the northeast corner of the subject property. Located in this <br />area is approximately 50 feet of chain link fencing which will be replace in a Cost to Cure. The <br />second temporary easement area lies just north of the start of the acquisition area. It is a strip of <br />land 35 feet in length having a width of approximately 100 +/- feet. Finally the last portion of the <br />subject property which is being encumbered by a temporary easement is the far southern tip of the <br />subject property. This area is currently being used as the storage area for wood chips for the <br />residents of Little Canada. Total area of all land encumbered by the temporary easement is 10,450 <br />s.f. These areas will be encumbered until December 1, 2009, or until at a time which the <br />Commissioner of Transportation determines by formal order that it is no longer needed for highway <br />purposes. <br />
