MINUTES <br />PLANNING COMMISSION <br />MAY 13, 2004 <br />than the Commission recommends approval of the Option 3 Preliminary <br />Plat for Hidden Acres with the City's consideration of upgrading the <br />Nadeau Road /Burke Lane /Condit Street intersection, with both options <br />subject to compliance with the recommendations of the City Planner and <br />City Engineer. <br />Motion seconded by Barraclough. <br />Motion carried 6 — 0. <br />Duray asked for an explanation of the Conditional Use Permit for <br />Residential PUD to allow variance in side yard setbacks for Hidden Acres. <br />The City Planner pointed out that the standard residential side yard <br />setback is 10 feet on each side. The application is requesting a CUP for a <br />Residential PUD to allow a 5 -foot side yard setback on the garage side of <br />the house. This will allow the garages to be side loaded rather than front <br />loaded. If the garages are front loaded, the houses will be pushed further <br />back thus putting the structures closer to the rear yard property lines. The <br />Planner noted that the proposed lots are wider than the City's minimum <br />75 -foot lot width. <br />The Planner indicated that one issue is how to address the side yard <br />setback for future additions to these houses. The Planner noted that the <br />City of Shoreview, for example, provides that the future addition of living <br />space must comply with the l0 -foot side yard setback requirement. The <br />Planner recommended that this condition be included as a part of the PUD <br />Agreement for the development as well as a covenant on the property so <br />that future owners will be aware of it. <br />Nancy Walstead asked if the houses would be closer to the shared back <br />property lines. The Planner noted that a front loaded garage would push <br />the houses further back, thus making them closer to the rear lot line. <br />However, under the CUP being requested, garages could be side loaded <br />and a larger backyard space maintained. The Planner noted that, at a <br />minimum, a 30 -foot rear yard setback has to be maintained. <br />Jack Bougie asked if he would be allowed a 5 -foot side yard setback for <br />his home. The Planner pointed out that this Residential PUD would apply <br />to Hidden Acres only if approved. Any change in setback requirements <br />that would apply to properties in the City in general would have to be <br />requested as a Text Amendment to the City's Zoning Code. <br />Gordie Howe explained that the processina of a CUP for Residential PUD <br />for plats is common in other cities. <br />
