Hanson <br />Per the Council's direction, staff is attaching the pertinent minutes relative to the discussion of a park <br />charge for the new Frattalone complex off of Spruce Street. The minutes that are enclosed are as follows: <br />➢ Council Meeting of 11/22/97 <br />➢ Park Commission of 6/28/01. <br />• Council Workshop of 7/25/01. <br />➢ Council Meeting of 7 /25/01. <br />Also enclosed are two diagrams depicting the easement /trail situation. The first is from the materials <br />associated with St. Paul Regional Water System's subdivision of the property. You will note we asked <br />for a 15 -foot trail easement within the 30- wetland setback. The second is a site plan from the Frattalone <br />project that gives a perspective of the trail alignment. <br />My perspective on this matter is as follows: <br />1. A 15 -foot easement was requested from SPRWS relative to the current Blacktern Office Park and <br />Frattalone Excavating sites. <br />2. The Blacktern site dedicated a 30 -foot easement versus the requested 15 -foot easement <br />requested to make it easier to describe the easement area. Given that no buildings could be <br />located within the 30 -foot area and that the path was to "meander" through this easement, <br />dedicating 30 feet did not negatively impact the site. <br />3. Buildings were required to be setback 50 feet for the wetland per Ramsey /Washington Metro <br />Watershed District requirements. <br />4. Mr. Frattalone dedicated a 30 -Coot easement on the site he purchased from SPRWS to fulfill that <br />requirement. (I believe 30 feet was dedicated versus 15 feet for the same reason as listed in #2 <br />above.) <br />5. We did ask for a 30 -foot easement from Mr. Frattalone at the Council meeting of 7.25.01. <br />6. We also asked for a 30 -foot easement from the former Pioneer Cabinet property that had not been <br />part of any earlier property division proceedings. (It was part of the Frattalone PUD approval <br />process.) <br />
