May 26, 2004 <br />Mr. Patrick Sweeney <br />Sweeney, Borer, Sweeney <br />Attn: Pat Sweeney <br />3250 Rice Street <br />Little Canada, MN 55126 <br />RE: Suggested Resolution to Code Violations at 421 Eli Road — Jim Cossack <br />Dear Mr. Sweeney: <br />I am writing this letter regarding the outstanding violations at 421 Eli Road. On March 24, <br />2004, Mr. Cossack applied for a building permit to add an addition to his home. This would <br />be an addition to the home that would connect the spa room (structure built without any <br />permits) to the existing home and resolve the issue involving the existence of accessory <br />buildings (the spa and the existing garage) exceeding 1,500 square feet (City Zoning <br />Ordinance 903.020.D.4). The building permit was issued on April 13, 2004. <br />Mr. Cossack's past actions have demonstrated a total disregard of the Little Canada Zoning <br />Code, Municipal Code, and State Building Code. As a result, we are listing the following <br />specific requirements and deadlines we would request be ordered by the Court to ensure <br />compliance and timely completion of this addition. Mr. Cossacic has indicated to me his <br />agreement with the following provisions: <br />1. Mr. Cossack will not be required to provide evidence of construction financing. He is <br />financing this addition with available proceeds. The City is willing to take him at his <br />word on this matter. However, should construction not be completed in a timely <br />manner (see schedule to follow), lack of financing will not be an acceptable reason <br />for delay. Should Mr. Cossack claim financing is causing his delay, and then he will <br />be deemed in default of this agreement and subject to all court sanctions. <br />2. Continued and satisfactory progress towards construction of the addition and spa to <br />ensure their timely completion and to achieve resolution of outstanding code <br />violations. The following inspection/completion schedule has been agreed to by Mr. <br />Cossacic and will be monitored by the City's Building Official based upon State <br />Building Code requirements. The City will be tracking progress of the project with <br />the inspection record card posted on the site, along with the standard building <br />4 <br />
