inspection reports. Mr. Cossack and /or his contractors are required to notify the City <br />of the need for inspections as are typically required in the building <br />permit /construction process. (An inspection record that lists the required inspections <br />has been provided as part of permit issuance and is currently posted inside the spa <br />structure on the subject property.) The schedule is attached as Exhibit A. <br />3. Restitution for NSF check #1040 made by American Mortgage Services and executed <br />by Mr. Jack Knodle on property owners behalf in the amount of $52.50 plus $20 NSF <br />fee must be made to City of Little Canada by May 28, 2004. This check was for the <br />electrical permit for the addition to the existing house. <br />4. Restitution for NSF check #1041 made by American Mortgage Services and executed <br />by Mr. Jack Knodle on property owners behalf in the amount of $73.50 plus $20 NSF <br />fee must be made to City of Little Canada by May 28, 2004. This check was for the <br />electrical permit for spa. <br />5. No occupancy of the spa is allowed until the final building inspection has been for the <br />spa and the hallway connecting the existing house to the spa is fully completed and <br />signed off on by the Building Official. Furthermore, property owner must complete <br />the balance of the addition work by December 31, 2004. It should also be noted that <br />past inspections of the property have indicated that Mr. Cossack has been using the <br />spa room. From a life safety and code compliance standpoint, no occupancy is <br />allowed the spa and connecting hallway are completed and approved. <br />6. Ivlr. Cossack must obtain a fill permit for the material he has already placed in the <br />rear yard area, outside of the existing fence. The permit shall be applied and paid for <br />by no later than June 5, 2004. The fill permit must denote the areas fill is to be placed <br />(the proposed berm, along the exterior of the fence, along the interior of the fence <br />between the spa and garage, by the exterior of the fence adjacent to the garage, and <br />any other areas proposed to be filled). Mr. Cossack must also comply with all of the <br />terms and conditions made part of the permit if approved by the City. <br />7. The fence Mr. Cossack has installed on the property is still out of compliance. To <br />resolve this matter, additional fill needs to be added on the exterior and interior of the <br />fence to ensure that the elevation above grade does not exceed 6 % feet. Corrective <br />action needs to be completed and verified by June 30, 2004. Note: this work <br />requires the issuance of an approved fill permit by the City of Little Canada. <br />8. The City of Little Canada will dismiss the civil case against Mr. Cossack subject to <br />his agreement with the outcome of the criminal proceedings and subject to payment <br />to the City of $2,240 for the City's out -of- pocket costs incurred to date. Said <br />payment shall be made with cash, cashier's check, or certified check to the City or <br />City Attorney prior to the scheduled court time on May 26, 2004. <br />9. Mr. Cossack will plead guilty to all outstanding charges made by the City of Little <br />Canada. The court will then grant a stay of adjudication through December 31, 2004. <br />5 <br />
