Following the unanimous approval by the Planning Commission, we have <br />continued to refine the Plat with the view to improving it. In our meeting yesterday we reviewed <br />Mr. Hanson's letter of July 21, 2004. While we wish we had been favored with the letter earlier, <br />as we indicated yesterday, these conditions could be made express conditions of a preliminary <br />plat approval and also bolstered with an interim development agreement in addition to being <br />expressly stated as conditions in the City Council's Resolution. My client could then secure <br />watershed district review and recommendation and return to the City to present those <br />recommendations and have them integrated into the Nan by the City Council. <br />As we discussed, final plat approval does not depend simply on whether the fmal plat is <br />consistent with the preliminary plat. According to the statute (462.358 subd.3B), the final plat <br />must also meet the conditions established in connection with the preliminary plat. Obviously the <br />City Council would expressly reserve the right to modify the plat, grading plan or landscape plan <br />following watershed review and consultation with your planning staff.
