Hanson <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: July 21, 2004 <br />RE: Hidden Acres Development Agreement <br />Attached is the proposed development agreement with Masterpiece Homes, Inc. involving the <br />plat of Hidden Acres. The agreement follows our standard format with notable modifications as <br />follows: <br />• City requirement to acquire 16 feet for Nadeau Road, subject to financial viability. <br />Developer is responsible for infrastructure construction. <br />• Developer may be granted up to three building permits for lots within the Hidden Acres <br />plat before the completion of required improvements with the understanding that no <br />certificates of occupancy will be granted by the City until the first lift of asphalt is <br />installed and approved by the City. <br />• Developer is to prepare restrictive covenants that protect the steep slope along Lots 4, 5, <br />and 6. Another covenant is required acknowledging the consent of future property <br />owners to the possible construction of a pedestrian bridge in this area. <br />• All construction traffic is to access the development area via the 30 -foot Nadeau Road <br />right -of -way. No use of Burke Lane or Yorkton Way is permitted without the expressed <br />written consent of the City Administrator. (This would only be granted in the event that <br />it is not practical to use the Nadeau Road route due to infrastructure construction within <br />this area that prevents any reasonable access.) <br />• Pond plantings must be approved the Ramsey /Washington Metro Watershed District and <br />City Staff. <br />• Developer will cooperate with the City in the implementation of a tax abatement program <br />to enable the recovery of costs for the Nadeau Road right -of -way including the possible <br />advancement of all costs to accomplish said acquisition with subsequent reimbursement <br />by the City. (Note: We will need to decide whether it is more advantageous for the <br />developer to advance the costs and be reimbursed by us or whether we should advance <br />the costs and reimburse ourselves.) <br />Subject to any comments by the City Attorney, staff recommends approval as presented. <br />cc: Gordie 1-lowe <br />
