This provision is consistent with <br />an agreement between the City and Developer, dated March 22, 2004, which is attached hereto <br />and incorporated herein as Exhibit B. <br />Engineering <br />16. The Developer shall grade the Plat as shown on the Grading, Drainage & Erosion <br />Control Plan prepared by the Developer's engineer and approved by the City's engineer. Said <br />Plan must be approved by the Ramsey- Washington Watershed District, including the completion <br />of a municipal coordination check list. It is also understood that the Erosion control plan must be <br />such that drainage to adjacent property is prevented and surface water run off is properly <br />controlled. Developer agrees to comply with any and all requirements for erosion control <br />directed by the Ramsey- Washington Watershed District and /or the City in a timely matter. <br />Developer's engineer shall certify that Plat grading is completed in accordance with the approved <br />grading and sediment control plan before the City shall issue any building permits. The <br />Developer shall remain ultimately responsible for accurate grading of all lots and shall correct <br />deficiencies in grading that may be discovered while this agreement is in effect. The City may <br />require sodding of any drainage swales to ensure protection of finished grades prior to the <br />occurrence of any housing construction. The City may also require verification of final <br />conformance to the grading and drainage plan at its discretion. <br />17. Developer or their agents or assigns, shall keep the public streets clear of any soil, <br />earth or debris resulting from work done by Developer or their agents or assigns. Any such <br />materials must be promptly removed and in no event shall they be present more than 24 hours <br />after placement. Failure to comply with this provision will result in the City undertaking this <br />work with costs to be reimbursed by Developer pursuant to Paragraph # 15. Furthermore, <br />Developer agrees that all construction traffic access the development area shall enter and exit <br />from the existing thirty (30) Foot Nadeau Road right -of -way.
