Hidden Acres <br />Development Contract <br />specifications and standards. No financial assistance is being provided by the City as to the <br />Required Improvements, except for the acquisition of 16 feet of public right -of -way from 2883 <br />Condit Street. <br />23. Developer agrees to be responsible for construction of street, curb & gutter, <br />drainage improvements, sanitary sewer main and services, water main and services, street <br />lighting, and signage for the extension of Nadeau Road from Developer's property east to the <br />intersection with Condit Street. Developer further acknowledges construction of said <br />improvements cannot occur until City has gained title to an additional 16 feet of right -of -way <br />from 2883 Condit Street. City acknowledges its responsibility to acquire an additional 16 feet of' <br />right -of -way from 2883 Condit Street, subject to the financial viability of said action as <br />determined in City's sole discretion. City will attempt to acquire this right -of -way by no later <br />than June 1, 2005. Developer will complete improvements on this additional street section as <br />soon as practical an no later than October 1, 2005 with the exception of the final lift of asphalt <br />which shall not be installed until after the street has been through one freeze /thaw cycle. <br />Developer further agrees that all costs associated with these improvements shall be the sole <br />expense of the Developer, except for those directly related to right -of -way acquisition. <br />Easements <br />24. Developer shall acquire and dedicate easements as necessary for the construction <br />and maintenance of the Required Improvements pursuant to City requirements, including, but not <br />limited to utility easements for sanitary sewer and water systems and any other easements the <br />City deems appropriate. Developer shall pay all costs relating to the acquisition of the necessary <br />easements, including attorney's fees, costs, appraisals, the cost of the necessary property, and <br />any other special conditions, which Developer shall negotiate with any affected property <br />owner(s). Developer also agrees to reimburse City for any costs associated with the acquisition <br />of the easements including drafting, review and recording. (Note: This provision does not apply <br />
