MIN UTES <br />PLANNING COMMISSION <br />NOVEMBER 16, 2004 <br />PLANNED <br />UNIT <br />DEVELOPMENT <br />PERMIT — <br />2866 MIDDLE <br />STREET — <br />JAKE FUHRMAN <br />AND JANEL <br />RUSSELL <br />Jake Fuhrman and Janel Russell appeared before the Commission <br />relative to their request for a Planned Unit Development Permit to allow <br />a non - traditional retail business at 2866 Middle Street in the Market <br />Square Town Offices. Russell indicated that they have received the <br />recommendations of the City Planner and are in agreement with them. <br />She asked about the recommendation that the City reserve the right to <br />review the permit to ensure that the use has not overburdened the site <br />with parking demand due to a higher- than - expected level of customer <br />traffic. Russell asked what the review would consist of as well as how <br />long the PUD Permit would run. <br />The City Planner indicated that the PUD Permit would run with the land <br />and as long as a business operates under the conditions of the permit, it <br />would remain in effect. This means that the business could be sold to a <br />similar business and the PUD Permit would remain in effect. <br />Russell explained the nature of the business which involves the design and <br />licensing of various product categories such as children's clothing, <br />stationary, timepieces, picture frames, Christmas ornaments, and jewelry. <br />These designs are licensed to high volume sales channels. Russell <br />explained that they do sell jewelry at retail, but by appointment only. <br />Russell presented the Commission with a floor plan for their space which <br />she pointed out consists primarily of office space with no designated retail <br />space. There will be a small display area in the conference room. <br />Keis asked how the business is advertised. Russell replied that they do no <br />advertising and customers come to them by word -of- mouth. Russell again <br />stated that they were fine with the recommendations of the City Planner, <br />they just wanted additional information on permit review. <br />Keis indicated that the purpose of any future permit review would be to <br />ensure that the business is not causing any parking problems. The City <br />Planner indicated that if there are complaints about parking or there is on- <br />street parking from the townoffice complex, the City would review the <br />permit. Knudsen indicated that there would be a validation of which <br />business is causing the parking problem. Knudsen indicated that the City <br />must make sure that each business is getting the amount of parking that <br />they bargained for. <br />The City Planner explained that the parking requirements for office space <br />are less than for retail space. This project was designed with a certain <br />number of parking spaces for office, and retail use would overburden the <br />parking supply. If there was a complaint, the City would identify which <br />business is overburdening the parking and would try to work with the <br />business to resolve the issue. <br />
