The Defendant entered a guilty plea to misdemeanor furnishing alcohol to a <br />minor. The Defendant was given ten days of stayed jail time and placed on probation for one <br />year with conditions of no further violations, and a $115.00 fine. <br />As you know, section 703.130 of the Little Canada Code indicates that every licensee is <br />responsible for the conduct of any employee in the licensed establishment. As stated above, the <br />Tierney's Liquor employee has admitted the sale of alcohol to a person under the age of twenty - <br />one. Accordingly, pursuant to section 703.170 of the Little Canada Code the council "shall either <br />suspend for up to sixty days or revolve any 3.2 intoxicating liquor license, or impose a civil fine <br />not to exceed $2,000.00 for each violation upon a finding that the licensee has failed to comply <br />with any applicable statute, regulation, or ordinance relating to alcoholic beverages ". <br />As you know, the licensee is 6D:titled to notice followed by a hearing and a written <br />decision of the council. <br />If you have any further questions relative to this matter, please let me know. <br />Very try' yours, <br />SW <br />ER & SWEENEY <br />PJS:chl <br />Enclosure <br />eney <br />
