921. ADMINISTRATION - AMENDMENTS (INCLUDING REZONINGS) AND <br />CONDITIONAL USE P_LR24ITS <br />921.010. PROCEDURE. <br />A. The word amendment shall refer to Zoning Ordinance text <br />amendments, and Zoning District Boundary amendments <br />(rezonings) to the Official Zoning Map. Requests for <br />amendments or conditional use permits, as provided within <br />this Ordinance, shall be filed with the Zoning <br />Administrator on an official application form. Such <br />application shall be accompanied by a fee as provided for <br />by City Council Resolution. This fee shall not be <br />refunded. Such application shall also be accompanied by <br />ten (10) copies of detailed written and graphic materials <br />fully explaining the proposed change, development, or use <br />and a mailing list of owners of property located within <br />three hundred fifty (350) feet of the subject property <br />accompanied by an abstractor's certificate.* The request <br />for amendment or conditional use permit shall be placed <br />on the agenda of the first possible Planning Commission <br />meeting occurring after ten (10) days from the date of <br />submission. The request shall be considered as being <br />officially submitted when all the information <br />requirements are complied with. <br />*Note: When the properties surrounding the subject <br />property include townhouse or condominium development, <br />the applicant may submit a mailing list of property <br />owners obtained from the managers or homeowners <br />association of the townhouse or condominium development. <br />B. The Zoning Administrator shall instruct the appropriate <br />staff persons to prepare technical reports where <br />appropriate, and provide general assistance in preparing <br />a recommendation on the action to the City Council. <br />Additionally, the Zoning Administrator shall refer the <br />application to other local, state and special unit <br />governments where appropriate and when required. <br />C. The Planning Commission shall consider possible adverse <br />affects to the proposed amendment or conditional use. <br />Its judgment shall be based upon (but not limited to) the <br />following factors: <br />1. The applicant shall demonstrate by clear and <br />convincing evidence that the proposed action has <br />been considered in relation to the specific <br />policies and provisions of and has been found to be <br />consistent with the official City comprehensive <br />Land Use Plan. <br />921. -1 <br />-2 <br />
