AINLTES <br />CITY COUNCIL <br />JULY 28, 2004 <br />contacted Slumberland and questioned them about the wood burner, and <br />based on the answers to her questions, felt that Slumberland was doing <br />some exaggeration of their complaint. <br />Apish stated that the wood burner is not a nice neighbor, and pointed out <br />that during the heating season, it burns 24 hours per day, 7 days per week. <br />There was no one else from the general public present wishing to <br />comment on this matter. <br />Upon motion by Blesener, seconded by Montour, the public hearing was <br />closed. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2004 -7 -155 — DENYING THE VARIANCE TO <br />ALLOW OUTDOOR STORAGE IN EXCESS OF CODE <br />LIMITATIONS AS THERE IS NO H,4RDSHIP PRESENT TO <br />YY'4RRANT GRANTING THE VARIANCE, AND DENYING THE <br />AMENDMENT TO CONDITIONAL USE PERMIT TO MODIFY THE <br />SITE PLAN TO REFLECT ADDITIONAL OUTDOOR STORAGE AS <br />WELL AS ACCESSORY STRUCTURE FOR WOOD-BURNING <br />HEATING SYSTEM AS RECOMMENDED 13Y THE PLANNING <br />COMMISSION, AND INSTRUCTING PRECISION TREE TO BRING <br />THE PROPERTY INTO COMPLIANCE WITH THE ORIGINALLY - <br />APPROVED SITE PLAN WITHIN 60 D,1 YS <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4) Blesener, Montour, LaValle, Anderson. <br />Nays (0).
