AINLTES CITY COUNCIL JULY 28, 2004 contacted Slumberland and questioned them about the wood burner, and based on the answers to her questions, felt that Slumberland was doing some exaggeration of their complaint. Apish stated that the wood burner is not a nice neighbor, and pointed out that during the heating season, it burns 24 hours per day, 7 days per week. There was no one else from the general public present wishing to comment on this matter. Upon motion by Blesener, seconded by Montour, the public hearing was closed. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 2004 -7 -155 — DENYING THE VARIANCE TO ALLOW OUTDOOR STORAGE IN EXCESS OF CODE LIMITATIONS AS THERE IS NO H,4RDSHIP PRESENT TO YY'4RRANT GRANTING THE VARIANCE, AND DENYING THE AMENDMENT TO CONDITIONAL USE PERMIT TO MODIFY THE SITE PLAN TO REFLECT ADDITIONAL OUTDOOR STORAGE AS WELL AS ACCESSORY STRUCTURE FOR WOOD-BURNING HEATING SYSTEM AS RECOMMENDED 13Y THE PLANNING COMMISSION, AND INSTRUCTING PRECISION TREE TO BRING THE PROPERTY INTO COMPLIANCE WITH THE ORIGINALLY - APPROVED SITE PLAN WITHIN 60 D,1 YS The foregoing resolution was duly seconded by Montour.
