October 13, 2004 <br />Mayor Fahey and Members of the City Council <br />City of Little Canada <br />515 Little Canada Road <br />Little Canada, MN 55117 <br />Re: Purchase Agreement for Watershed's Purchase of Noel Drive Property <br />Dear Mayor and Council Members: <br />I respectfully request that the Council not take action at this time on a Purchase Agreement for the <br />Watershed's purchase of the Noel Drive Property until after the outcome of the Public Hearing that is <br />necessary relative to the development of this site. The City has already assured the Watershed via the <br />Letter of Understanding that the sale will move forward if conditions outlined in that Letter of <br />Understanding are met. <br />As you are aware, the Watershed has not yet submitted development plans for this property that <br />would meet the City's ordinance requirements. There are a lot of questions as to how the <br />Watershed's proposal will work on the site. Until those are answered, I do not believe the City <br />should enter into additional binding legal agreements with the Watershed. <br />The City has lived up to the commitments it made in the Letter of Understanding. I would ask that <br />the Watershed be required to live up to the commitments it made in agreeing with the terms outlined <br />in the Letter. One of those commitments is that a public hearing be held on the Watershed's proposal <br />prior to the execution of a Purchase Agreement. <br />I question why the Watershed is concerned about the potential transaction and requires greater <br />assurance that the sale will proceed.
