U4 Uh) U8 :26 STATE OF MN- PIPELINE SAFETY
Kenow, Charles
From:
Sent:
To:
Subject:
Gorham, Bob [Bab.Gorham @fire.ca.gov]
Monday, September 09, 2002 3:15 PM
Kenow, Charles
RE: Pipeline Development Set -backs
Charles,
California has a state law that prohibits structures on pipeline
right -of -way or adjacent to if the improvement prohibits complete and
unimpaired access. See text below. What this law does is allow a
developer to build a wall or structure adjecent to the easement on one
side only. The other side of the easement would have too allow room for
maintenance and emergency response. We consult with the operator to
tell us how much room they need
Bob
California Government Code:
51014.6. (a) Effective January 1, 1987, no person, other than the
pipeline operator, shall do any
of the following with respect to any pipeline easement:
(1) Build, erect, or create a structure or improvement within the
pipeline easement or permit the
building, erection, or creation thereof.
(2) Build, erect, or create a structure, fence, wall, or obstruction
adjacent to any pipeline
easement which would prevent complete and unimpaired surface access to
the easement, or
permit the building, erection, or creation thereof.
(b) No shrubbery or shielding shall be installed on the pipeline
easement which would impair
aerial observation of the pipeline easement. This subdivision does not
prevent the revegetation
of any landscape disturbed within a pipeline easement as a result of
constructing the pipeline and
does not prevent the holder of the underlying fee interest or the
holder's tenant from planting and
harvesting seasonal agricultural crops an a pipeline easement.
(c) This section does not prohibit a pipeline operator from performing
any necessary activities
within a pipeline easement, including, but not limited to, the
construction, replacement, relocation,
repair, or operation of the pipeline.
- --- Original Message- -
From: Kenow, Charles [ mailto :Charles.Kenow©state.mn.usj
Sent: Monday, September 09, 2002 7:35 AM
To: NAPSR Alabama (E- mail); NAPSR Arizona (E- mail); NAPSR Arkansas
(E- mail); NAPSR California PUC (E- mail); NAPSR California SFM (E- mail);
NAPSR Colorado (E- mail); NAPSR Connecticut (E- mail); NAPSR Delaware
(E- mail); NAPSR District of Columbia (E- mail); NAPSR Florida LPG
(E-mail); NAPSR Florida PUC (E- mail); NAPSR Georgia (E- mail); NAPSR
Idaho (E- mail); NAPSR Illinois (E- mail); NAPSR Indiana (E- mail); NAPSR
Iowa (E- mail); NAPSR Kansas (E- mail); NAPSR Kentucky (E- mail); NAPSR
Louisana (E- mail); NAPSR Maine (E- mail); NAPSR Maryland (E-mail); NAPSR
Massachusetts (E- mail); NAPSR Michigan (E- mail); NAPSR Minnesota
(E- mail); NAPSR Mississippi (E- mail); NAPSR Missouri (E- mail); NAPSR
Montana (E- mail); NAPSR Nebraska (E- mail); NAPSR Nevada (E- mail); NAPSR
New Hampshire (E- mail); NAPSR New Jersey (E- mail); NAPSR New Mexico
1
TEL:6512969641 P, 002
