MAPLEWOOD'S PIPELINE SETBACK ORDINANCE <br />Ken Roberts; Planner, has been with Maplewood for 13 years. During that time, he can think of only <br />one or two variances granted to the pipeline ordinance. These were due to the shape of the property <br />and in one instance a variance was granted provided that the property owner constructed a berm that <br />would deflect flowage from the pipeline should a leak have occurred. <br />According to Roberts, there were no variances denied. When developers come in, the staff informs <br />them that these are the regulations that must be met. Developers have taken those regulations and <br />have then worked within them. It is only the one or two variance requests mentioned above that have <br />been presented to the Council. <br />Existing lots of record are not subject to the setback ordinance. It is only when new lots are being <br />created, or a large commercial property is being developed that the ordinance comes into play. For <br />Large commercial properties, developers have been able to design around the pipeline, placing <br />parking lots nearer the pipeline and the buildings away from it thus meeting setback requirements. <br />
