MINUTES <br />CITY COUNCIL <br />SEP UMBER 25, <br />STAGE PUD, <br />REZONING — <br />3203 COUNTRY <br />DRIVE — <br />DRYWALL <br />SUPPLY <br />ACCEPTANCE <br />OF SEWER <br />EASEMENT — <br />COMMON <br />BOND <br />2002 <br />requested by Carl Johnson. It was noted that the Planning Commission <br />recommended approval as outlined in the minutes of their September <br />12, 2002 meeting and subject to compliance with the recommendations <br />of the City Planner and the City Engineer, with the City Planner to <br />establish a timetable and interim development plan that will be <br />incorporated into the Development Agreement for this property. <br />Scalze noted that previous representations made by the property owner <br />indicated that the soils were too poor to build on the back of the property. <br />The development plans now show a proposed building in this area. <br />Anderson suggested that it may be a pole building. <br />Fahey noted that the City Administrator is recommending that action on <br />this proposal be tabled at this time given a number of outstanding issues as <br />outlined in is report dated September 18, 2002. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2002 -9 -224 - TABLING ACTION ON THE <br />APPLICATION FOR PRELIMINARY PLAT FOR DRYWALL <br />SUPPLY, DEVELOPMENT STAGE PUD, AND REZONING OF A <br />PORTION OF THE PROPERTY TO LIGHT - INDUSTRIAL AS <br />REQUESTED BY CARL JOHNSONSUI3JECT TO COMPLIANCE <br />WITH THE RECOMMENDATIONS OF THE CITY <br />ADMINISTRATOR AS OUTLINED IN HIS LETTER DATED <br />SEPTEMBER 18, 2002 <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Montour, Scalze, Anderson. <br />Nays (0). Resolution declared adopted. <br />The City Administrator reported that there was a need to obtain a sewer <br />easement from Presbyterian Homes in order to allow access to a sewer <br />line on the Garden Terrace property owned by Common Bond. The <br />Administrator reviewed the details of that easement, noting that if the <br />easement area is disturbed on the Presbyterian Homes property as the <br />result of the need to access the line, the City will be responsible for <br />restoration costs. He noted Presbyterian Homes is allowed to expand their <br />utilization of this area by landscaping, fences, and driveways.
