MINUTES <br />CITY COUNCIL <br />JANUARY 16, 2008 <br />The foregoing resolution was duly seconded by Allan. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />IMP. NO. Mayor Blesener opened the public hearing to consider the improvement <br />2008-02 - of Condit Street by reconstructed road surface, concrete curt and gutter, <br />CONDIT and drainage enhancements. <br />STREET <br />The City Engineer presented a detailed report relative to this proposed <br />improvement. That report outlined the project history relative to street <br />condition and utilities. The Engineer noted that the pavement rating for <br />Condit Street is 38 out of a possible 100. There is varying right-of--way <br />width as well as pavement width along Condit Street. All adjacent <br />properties are served by watermain and sanitary sewer. There is a <br />minimal storm sewer collection system in place with catch basins at the <br />intersection with South Owasso Blvd. <br />The Engineer review the portion of the Condit Street improvement <br />proposed for that segment lying between Nadeau Road and South Owasso <br />Blvd. He pointed out that it will be necessary to obtain an additional 17 <br />feet of right-of--way on the west side of the road from the two properties <br />south of Yorkton Ridge. This section of road would be reconstructed as a <br />28-foot urban section street. Concrete curb and gutter with concrete <br />driveway aprons are proposed. Where feasible, front yards will drain to <br />the street, catch basins would be installed to provide drainage, and rain <br />gardens would be added for storm water treatment <br />The Engineer noted that the right-of--way for Condit Street lying between <br />Nadeau Road and Burke Street is only 30 feet wide and would not <br />accommodate the standard 28-foot improvement. The acquisition of <br />additional right-of--way would create non-conforming lots. Therefore, the <br />proposal is to construct a substandard 24-foot wide urban street with no <br />parking on either side of the street. <br />The Engineer continued his report, reviewing the City's assessment policy <br />in detail. He noted that residential street reconstruction is assessed at 85% <br />of an 8"/3" urban section street. However, assessment costs are capped at <br />a maximum of $57.97 per front foot. The Engineer then reviewed the <br />assessments proposed for the adjacent commercial policy, noting that 80% <br />of project costs are assessed, except that storm sewer would not be <br />assessed, and concrete curb and gutter is assessed at 100%. Assessments <br />would again be based on front footage at a commercial capped rate of <br />$118.18 per front foot. The Engineer noted that there is one <br />commercially-zoned property being used as residential. The property <br />owner would have the option of deferring the difference between the <br />
