MINUTES <br />CITY COUNCIL <br />JANUARY 16, 2008 <br />commercial and residential rate until the property is sold for commercial <br />use. Interest could accrue on the deferred portion of the assessment. <br />He then reviewed the proposed project schedule as well as construction <br />issues that are typical of any project. <br />Elaine Zoch indicated that they are not in favor of the project and do not <br />agree that the road needs to be reconstructed. Zoch suggested a <br />resurfacing of the road. Zoch also expressed concern with the need for <br />retaining walls and the loss of significant evergreen trees on their property <br />as a result of reconstruction. Zoch noted that they also owned the lot at <br />the corner of Condit Street and Yorkton Ridge and was concerned that the <br />additional right-of--way needed for the street would make this lot <br />substandard. Zoch felt that the project would result in a lot of money <br />being spent on a road that sees very little traffic. Should the project <br />proceed, Zoch indicated that she had a lot of questions. <br />Marcel Zoch indicated that he opposed the road project, and was strongly <br />objected to the loss of his trees. Zoch felt that the project should be denied <br />and was a waste of money. He also felt that the additional right-of way <br />that was needed should have come from the east side of Condit. <br />Allan asked how the Zoch property came to be zoned B-3. Elaine Zoch <br />reported that when the City was proposing the rezoning of the property on <br />the east side of Condit to B-3 District, she and her husband objected to the <br />rezoning. The City then offered to rezone their property to B-3 stating that <br />it would be more valuable. <br />The City Administrator agreed that the Zoch property would be greatly <br />impacted by the Condit Street improvement. He indicated that staff <br />considered a 24-foot versus 28-foot wide road improvement, however, the <br />tree loss is the same. The Administrator noted that the power lines run <br />through many of the trees, but agreed that the trees are large and mature. <br />The Administrator indicated that City staff is recommending the retaining <br />wall along the west side of the road. He noted that the developer did not <br />put one in on the east side of Condit due to cost considerations. <br />Marcel Zoch questioned the impact of the retaining wall his corner lot. <br />The City Administrator reported that the retaining wall would be installed <br />to protect the grade. As the grade decreases, so would the height of the <br />retaining wall. The Administrator noted that the Condit Street <br />improvement issues with the Zoch property are the need for a retaining <br />wall, impact on evergreens, and the need to move some trees on the north <br />end of the driveway. The Administrator reported that he informed the <br />Zoch's that the City would be willing to do tree replacement, moving in <br />trees as large as possible to replace those that are lost.
