The state must also allow for city <br />managers to opt -in to PERA provided there is no employer buy -back obligation. <br />3 <br />4 HR -9. State Paid Police and Fire Medical Insurance <br />5 <br />6 • The state must fully fund programs that pay for health insurance for police and fire <br />7 employees required under Minn. Stat. § 299A.465, as amended in 1997, for police and fire <br />8 employees hurt or killed in the line of duty. <br />9 <br />10 • The Legislature must clarify whether Minn. Stat. § 299A.465 applies to injuries incurred <br />11 prior to June 1, 1997 (the effective date of the law). <br />12 <br />13 • The Legislature must clarify the amount of an employer's contribution under Minn. Stat. § <br />14 299A.465 and whether it changes over time. <br />15 <br />16 • The Legislature must identify a single public entity as the authority for making the disability <br />17 determination for purposes of the benefits assigned under Minn. Stat. § 299A.465, establish <br />18 the minimum criteria used to determine ability to work, and set a percentage threshold of <br />19 disability for eligibility into this program. <br />20 <br />21 HR -10. Breathalyzers <br />23 • Minn. Stat. § 181.950 -.957 should be amended to permit the use of breathalyzers as an <br />24 acceptable technology for determining alcohol use. Currently, breathalyzer use is permitted <br />25 under federal commercial drivers' laws. <br />26 <br />27 HR -11. Drug and Alcohol Rehabilitation <br />28 <br />29 • Under Minn. Stat. § 181.953, subd. 10(b), an employer cannot terminate an employee for a <br />30 positive controlled substance test without first providing the employee a chance for <br />31 rehabilitation and treatment. Recently, some cities have been advised that this law applies to <br />32 "probationary" employees as well as permanent employees. Therefore, the League supports a <br />33 legislative change to clarify that the state law on drug and alcohol rehabilitation and <br />34 treatment does not apply to probationary employees. <br />35 <br />36 HR -12. Health Care Insurance Programs <br />37 <br />38 • The League supports voluntary participation in programs designed to provide for post - <br />39 retirement health insurance benefits or in health insurance plans structured to pool all public <br />40 employees. <br />41 <br />rtj <br />44 <br />37 <br />
