for City business. This rate may be adjusted by City from time to time in conjunction with <br />changes to Internal Revenue Service regulations. <br />15. "AT WILL" EMPLOYMENT. Westerhaus understands and agrees that his employment <br />with the City of Little Canada is "at will" and may be terminated without cause, without the <br />need to indicate a specific reason, and with or without notice at any time at the option of either <br />himself of the City of Little Canada. <br />As at "at will" employee, Westerhaus understands and agrees that neither this document, any <br />policy of the City, nor any representation made by City to him shall be construed to constitute <br />a contract of employment or a modification of his "at will" employment. Westerhaus <br />understands and agrees that his position as a department head is specifically excluded from <br />City's Personnel Policy and that the provisions contained in said Personnel Policy have no <br />application to his employment, except as stated herein. All rights governing his employment <br />relationship with City are set forth in this Agreement. <br />16. OTHER PROVISIONS TO APPLY. Westerhaus shall be subject to Section 15 of City's <br />Personnel Policy entitled "Other Information" during his tenure with City. Westerhaus <br />acknowledges receipt of this section as well as any other sections of the Personnel Policy <br />previously referenced in this Agreement. <br />17. SEVERABILITY. If any provision, or any portion thereof, contained in this Agreement is <br />held to be unconstitutional, invalid, or unenforceable, the remainder of this Agreement, or <br />portions thereof, shall be deemed severable, shall not be affected, and shall remain in full <br />force and effect. <br />18. EFFECTIVE DATE. This Agreement shall become effective January 1, 2003. <br />5 <br />
