3rd ADDENDUM AGREEMENT FOR BUILDING INSPECT ION SERVICES This 3"1 Addendum made and entered into this 13`x' day of November, 2002 by and between the City of Little Canada, Minnesota (hereinafter referred to as "City "), and Northland Inspections, Stephen J. Westerhaus, President (hereinafter referred to as "Building Official ") and replaces the sections of the "Agreement for Building Inspections Services" as previously entered into by the "City" and "Building Official" dated March 1, 2000 and amended on October 9, 2000 and December 19`11, 2001. II. SCHEDULE OF FEES AND CHARGES Subject to the execution of this 3`d Addendum by City and Building Official, compensation payable shall be based upon the Exhibit B, Revised Fee Schedule contained within the 2 "a Addendum with the understanding that said fees shall be applied to work in progress based on Exhibit A attached to this Addendum. III. EFFECTIVE AND TERMINATION DATES 1. Effective Date. This 3`a Addendum shall be effective as of November 14, 2002 or the date by which the City has successfully entered into an Employment Agreement with Stephen Westerhaus and an Agreement with the City of Falcon Heights for a shared building official position. Should the City not be able to enter into both agreements, this 3rd Addendum is null and void. 2. Termination. This Agreement shall teiniinate on December 31, 2002 by the mutual consent of both parties hereto. Upon execution of his 3rd Addendum, City and Building Official hereby agree to waive previous notice provisions for termination. Compensation payable shall be made pursuant to Section III as outlined in this document. In witness thereof, the parties have executed this Addendum the day and year first written above.
