AND WHEREAS, <br />A public hearing was held on July 24, 2002 before the City Council in the City Center <br />after due published and posted notice had been given by the City Administrator, a <br />reasonable attempt was made to give personal notice to all affected property owners, and <br />all persons interested were given an opportunity to be heard; <br />AND WHEREAS, <br />Any person, corporation, or city owning or controlling easements contained upon the <br />property vacated, reserves the right to continue maintaining the same or to enter upon <br />such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise <br />attend thereto; <br />AND WHEREAS, <br />It appears that it will be in the best interest of the City to vacate such access easement; <br />AND WHEREAS, <br />Four -fifths of all members of the City Council concur in this resolution; <br />NOW, THEREFORE, BE IT RESOLVED, that the access easement as described below <br />is hereby vacated: <br />That part of the Southwest Quarter of Section 6, Township 29, Range 22, Ramsey <br />County, Minnesota, described as follows: <br />A strip of land 50.00 feet in width, the centerline of which is described as <br />commencing at the intersection of the south line of the north 195.63 feet of <br />said Southwest Quarter of Section 6, with the west line of the Northeast <br />Quarter of said Southwest Quarter of Section 6; thence on an assumed <br />bearing of North 89 degrees 58 minutes 55 seconds East, along said south <br />line of the north 195.63 feet of the Southwest Quarter, a distance of 35.00 <br />feet; thence South 1 degree 04 minutes 35 seconds East a distance of 2.22 <br />feet to the point of beginning of the centerline to be described; thence <br />North 1 degree 04 minutes 35 seconds; West a distance of 20.00 feet; <br />thence North 36 degrees 26 minutes 35 seconds West a distance of 145.00 <br />feet and said centerline there terminating. <br />
