AND WHEREAS, A public hearing was held on July 24, 2002 before the City Council in the City Center after due published and posted notice had been given by the City Administrator, a reasonable attempt was made to give personal notice to all affected property owners, and all persons interested were given an opportunity to be heard; AND WHEREAS, Any person, corporation, or city owning or controlling easements contained upon the property vacated, reserves the right to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereto; AND WHEREAS, It appears that it will be in the best interest of the City to vacate such access easement; AND WHEREAS, Four -fifths of all members of the City Council concur in this resolution; NOW, THEREFORE, BE IT RESOLVED, that the access easement as described below is hereby vacated: That part of the Southwest Quarter of Section 6, Township 29, Range 22, Ramsey County, Minnesota, described as follows: A strip of land 50.00 feet in width, the centerline of which is described as commencing at the intersection of the south line of the north 195.63 feet of said Southwest Quarter of Section 6, with the west line of the Northeast Quarter of said Southwest Quarter of Section 6; thence on an assumed bearing of North 89 degrees 58 minutes 55 seconds East, along said south line of the north 195.63 feet of the Southwest Quarter, a distance of 35.00 feet; thence South 1 degree 04 minutes 35 seconds East a distance of 2.22 feet to the point of beginning of the centerline to be described; thence North 1 degree 04 minutes 35 seconds; West a distance of 20.00 feet; thence North 36 degrees 26 minutes 35 seconds West a distance of 145.00 feet and said centerline there terminating.
