Agreement, or any act done under pretended authority of this Agreement. <br />This indemnification shall include any costs incurred by the City in defending <br />any action involving an act by the Lessee or any of its employees, independent <br />contractors, or agents, and shall include any reasonable attorney's fees <br />incurred by the City. <br />9. City's Fundraising Events. Lessee acknowledges that the City conducts <br />certain fundraising activities involving the concession stand at Pioneer Park. <br />In conjunction with the City's fundraising activities, Lessee will allow the <br />Little Canada Recreation Association to use the concession stand and any <br />subsequent improvements as well as equipment for fundraising events. Other <br />organizations must make arrangements with the City and Lessee for use of the <br />stand. <br />10. Loss of Profits. The City is not liable for loss of profits in the event the <br />contract is cancelled, for any reason. Lessee shall not be entitled to any future <br />profits or damages in the event that the City awards this contract to another <br />firm or retains the operation of the City activity at any time in the future. <br />11. Compensation. Lessee shall pay no fee to the City for the privileges herein <br />granted, other than maintenance, including opening and securing building as <br />referenced in item #12 of this Agreement. <br />12. Maintenance of Facilities. Lessee agrees to operate the concession stand in a <br />clean manner with quality products sold at a fair market price.
