With a <br />occupancy classification of B( business) and a Construction Type of V -N no openings are <br />permitted less than 5 feet to a property line and must be protected less than 10 feet. I have not <br />found any exception to this requirement in the building code, <br />RECOMMENDATION: <br />The building code does allow the building official to grant modifications on a individual bases <br />when there are practical difficulties involved in carrying out the provisions of the code if it is <br />found that the strict letter of the code is impractical and the modification does not lessen the fire <br />protection requirements or the structural integrity (UBC Section 104.2.7). I would recommend a <br />document be drafted and restrictions placed upon the properties in question so that the building <br />remains in the hands of one owner and any sale of either piece of property would trigger a review <br />by the City of Little Canada.
