J.) Water courses used solely for drainage, such as road side ditches, are exempt from this <br />provision. <br />Section 5.0. Review. The city engineer shall review the storm water pollution control plan. <br />This review must be completed within ( ) days of receiving the plan from the <br />applicant. <br />5.1 Permit Required. If the city determines that the stoma water pollution control plan meets <br />the requirements of this ordinance, the city shall issue a permit valid for a specified period of <br />time, that authorizes the land disturbance activity contingent on the implementation and <br />completion of the storm water pollution control plan. <br />5.2 Denial of Permit. If the city determines that the storm water pollution control plan does <br />not meet the requirements of this ordinance, the city shall not issue a permit for the land <br />disturbance activity. <br />A.) All land use and building permits for the site in question must be suspended until the <br />applicant has an approved storm water pollution control plan. <br />Section 6.0. Modification of Plan. An approved storm water pollution control plan may be <br />modified on submission of a written application for modification to the city, and after written <br />approval by the city engineer. In reviewing such an application, the city engineer may require <br />additional reports and data. <br />6.1 Records Retention. The city shall retain the written records of such modifications for at <br />least (_) years. <br />Section 7.0 Financial Securities. The applicant shall provide a financial security for the <br />perfomuance of the work described and delineated on the approved grading plan involving the <br />storm water pollution control plan and any storm water and pollution control plan related <br />remedial work in at a rate of three thousand dollars ($3,000) per acre for the maximum acreage <br />of soil that will be simultaneously exposed during the project's construction. (See the <br />definitions of "exposed soil area" and "final stabilization" for clarification.) This security must <br />be available prior to commencing the project. The form of the security must be: <br />7.011 By cash security deposited to the city for percent ( %) of the total financial <br />security in Section 7.0, when under five (5) acres of soil will be simultaneously exposed. When <br />over five (5) acres of soil will be simultaneously exposed, then the cash security increases to the <br />first thousand dollars ($_,000) or percent ( %) of the total financial security <br />in Section 7.0, whichever is greater. <br />
