(651)- 731 -0892 <br />SUBJECT: Application of Al and Cindy Mentes for Conditional Use Permit for Accessory <br />Garage at 3058 Greenbrier <br />My clients: Al and Cindy Mentes <br />Background The Applicants, Mr, and Mrs. Al Mentes, applied in July, 2001 for a Conditional Use <br />Permit (CUP) to construct a 1,008 (36 foot x 28 foot) square foot accessory detached storage garage <br />on the property. This application was made pursuant to Section 903.020 of the Little Canada Zoning <br />Code which provides that the total floor area of a garage and other accessory buildings for a single <br />family dwelling may not exceed 1,000 square feet except by conditional use permit. The ordinance <br />also states that in no instance may the total floor area of a garage and an accessory building <br />combined exceed 1, 500 square feet. The ordinance also provides at Section 903.020 D.4 that "No <br />accessory building or detached garage for a single family dwelling shall occupy more than twenty - <br />five percent of the area of the rear yard." <br />The residence at 3058 Greenbrier has an existing attached 440 square foot garage, which is <br />inadequate for the Mentes's needs. The total combined floor space of the existing garage and the <br />proposed accessory detached storage garage would be 1,448 square feet. The rear yard area of 3058 <br />Greenbrier is 149.4 feet x 111.91 feet (according to the survey on file) with a total rear yard area of <br />16,719.3. The total floor area of 1,448 square feet is well within the 25% ratio limit of the Code <br />which for 3058 Greenbrier would be 4,179.8 square feet. <br />Prior to purchasing the property at 3058 Greenbrier, Mr. and Mrs. Mentes were advised by the City <br />Planner, Steve Grittman, and the Building Inspector, Steve Westerhaus, that obtaining a conditional <br />use permit for a second detached storage garage would be no problem as long as the setback <br />requirements were observed. Mr. and Mrs. Mentes's realtor recalled that Mr. Grittman specifically <br />noted that other properties in the neighborhood had similar structures. Mr. and Mrs. Mentes <br />
