DEVELOPMENT AGREEMENT <br />THIS AGREEMENT is made and entered into as of the day of April, 2002, <br />by and between the CITY OF LITTLE CANADA, MINNESOTA (the "City ") and <br />N STAR ASSOC LP ( "North Star "). <br />RECITALS <br />A. WHEREAS, Minnesota Statutes 327.2, Subdivision 1, requires <br />manufactured home parks licensed prior to 1988 to have an evacuation <br />plan approved the local municipality, and <br />B. WHEREAS, North Star Estates is a manufactured home park with over <br />500 residents located in the City of Little Canada, and <br />C. WHEREAS, a reasonably accessible storm shelter does not exist within <br />North Star or in close proximity, <br />WHEREAS, the City has approved an interim evacuation plan that utilizes <br />the basement of St. John's Church as the designated storm shelter site <br />pending the construction of a new storm shelter within North Star, and <br />E. WHEREAS, the City has received Community Development Block Grant <br />Funding from Ramsey County for a new shelter to be constructed within <br />North Star (See Attachment A a copy of the grant application), and <br />F. WHEREAS, the City and North Star want to cooperate to the fullest extent <br />possible to construct a new shelter within North Star as soon as practical <br />in calendar year 2002, and <br />G. The purpose of this Agreement is to set forth the understanding between <br />the City and North Star with respect to the construction and operation of a <br />storm shelter within North Star Estates. <br />TERMS AND CONDITIONS <br />NOW, THEREFORE, in consideration of the mutual undertakings herein <br />expressed, the City and North Star agree as follows: <br />1. Full Cooperation. North Star and the City agree to cooperate fully with <br />each other to achieve the successful completion of this storm shelter <br />construction project. North Star acicnowledges its responsibilities <br />pursuant to the grant application filed with Ramsey County (Exhibit A) <br />and further agrees to assist the City in any reasonable way to ensure the <br />City's compliance with Community Development Block Grant Program <br />
