Agreement between the City and Ramsey County Housing and <br />Redevelopment Authority dated July 1, 2001. (Exhibit 13) <br />2. CUP Application. North Star will apply for a Conditional Use Permit on <br />the City's behalf to allow the construction of a storm shelter adjacent to <br />the office building in North Star Estates. Said application will be made by <br />April 25, 2002. It is hereby noted that only one storm shelter is proposed <br />to be constructed versus the two shelters noted in the grant application <br />attached as Exhibit A. <br />3. Cash Deposit. North Star will make a cash deposit with the City of <br />$34,500 to be used for costs relative to the construction of the new storm <br />shelter including but not limited to legal, administrative, planning, <br />engineering, soil borings and analysis, surveying, etc. It is hereby <br />understood that this amount will be North Star's financial contribution to <br />the project and shall be the first dollars used for the overall project costs. <br />4. City Reimbursement of Costs. North Star also agrees that the City shall be <br />reimbursed for all of its costs associated with the construction of the storm <br />shelter. <br />5. Subdivision of Properties. A subdivision of property by North Star may <br />be necessary to create a separate legal description and parcel to facilitate <br />the conveyance of the storm shelter site to the City. North Star agrees to <br />proceed in due fashion with any necessary subdivision to facilitate the <br />creation of a site for the storm shelter adjacent to the office complex. <br />6. Conveyance of Property. North Star agrees to convey, to the City, all <br />property necessary to facilitate the construction of the storm shelter <br />including fee title to the shelter site as well as any needed access <br />easements. The City's interests in said property shall revert back to North <br />Star if North Star Estates is no longer operated as a manufactured home <br />park for a period of one year. Said reversion shall occur by a quit claim <br />deed. <br />7. Ownership of the Storm Shelter. North Star acknowledges that the City <br />shall be the owner of the storm shelter and related appurtenances. As a <br />result, the City is responsible for the construction of these improvements <br />with said construction to done in compliance with local ordinances and <br />regulations imposed by Ramsey County as a result of the use of <br />Community Development Block Grant funding. North Star shall have the <br />right to approve the construction plans for said shelter, and approval may <br />not be unreasonable withheld in the sole determination of the City. <br />8. Lease Agreement. The City hereby agrees to enter into a long -term lease <br />agreement with North Star for the use, operation, and maintenance of the <br />2 <br />- 1 2 - <br />
