Fahey
COUNCIL
Beverly Scalze
Jim LaValle
Matt Anderson
Rick Montour
ADMINISTRATOR
Joel R. Hanson
The Minnesota Department of Public Safety, State Fire Marshal Division, Office of Pipeline
Safety, has published a Model Setback Ordinance that applies to new residential and other
development since July 1, 1991. The rules apply unless a community has a more restrictive
setback requirement.
SETBACK
Building and places of public assembly subject to this ordinance shall not be constructed closer
to the pipeline than the boundary of the pipeline easement.
ADDITIONAL INFO
• The setback requirements only apply to occupied buildings.
• No organized sports activities (i.e. soccer or baseball fields) over pipeline.
• There are no rules to prevent pipeline companies from reducing the width of their
easements.
• Pipeline Safety would prefer pipeline easement areas to be green space areas to aid in
leak detection.
PAGE 2
