DEVELOPMENT CONTRACT <br />AGREEMENT, dated May , 2002, by and between the CITY OF LITTLE CANADA, a Minnesota <br />municipal corporation, ( "City ") and St. Croix Development Group, LLC, a Minnesota Corporation ( "Developer "). <br />1. Request for Improvement. The Developer has requested the City to allow the construction of sanitary <br />sewer and services, storm sewer with retention ponding including wetland mitigation, water main and services, <br />grading, paving, curb and gutter, signage, and lighting necessary to serve and provide access to the proposed plat of <br />Edgewater Townoffice Park, within the City of Little Canada to serve the following described property, as shown on <br />Exhibit "A ": <br />Lots 1 -15, Block 1 of Edgewater Townoffice Park, County of Ramsey, State of Minnesota. <br />2. Conditions of Approval. The City hereby approves construction of necessary extensions of sanitary <br />sewer and services, storm sewer with retention ponding including wetland mitigation, water main and services, <br />grading, paving, curb and gutter, signage, and lighting to serve the Edgewater Townoffice Park plat, conditioned <br />upon the Developer entering into this Agreement and guaranteeing compliance with terms of this Agreement. <br />3. Compliance with Laws and Regulations. The Developer represents to the City that to the best of its <br />knowledge the construction of improvements to serve the Edgewater Townoffice Park plat will comply with all City, <br />County, Metropolitan, State and Federal laws and regulations, including, but not limited to, subdivision ordinances, <br />zoning ordinances, noise ordinances, and environmental regulations; including wetland impact and mitigation. The <br />Developer shall obtain all necessary permits and consents for the project including, but not limited to, any permits <br />required by the Minnesota Department of Health for water service, any necessary permits required from the <br />Minnesota Pollution Control Agency for sanitary sewer main extension, any necessary approvals from Metropolitan <br />Council - Wastewater Services Division for connections to sanitary sewer lines, any permit required by the Ramsey <br />County Department of Public Works for road access to Rice Street, any permits required from the Ramsey- <br />Washington Watershed District for grading and storm water discharge, and any permits or approvals necessary to <br />I- 1: \KrisP \CORRESP \Kris' 2002 \LC Office Park Development Contract.doc <br />-1- <br />PAGE 8 <br />
